Terms of Service

These terms are written to be read, not just filed away. If a section doesn't apply to how you use Trace, it still applies to how the app works overall.

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of Trace ("the app", "we", "us"), a personal memory and life-milestone app for iOS. By downloading, installing, or using Trace, you agree to these Terms. If you do not agree, do not use the app.

See also our Privacy Policy, which explains what data the app handles and what never leaves your device. It is incorporated into these Terms by reference.

2. Who can use Trace

Trace is not directed to children under the age of 13, and you must meet the minimum age required by your country to use the App Store and to agree to these Terms on your own behalf. If you are using a family-shared device, a parent or guardian is responsible for a minor's use of the app.

3. License to use the app

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Trace on Apple-branded devices that you own or control, for your own personal, non-commercial use, in accordance with the App Store's Usage Rules.

This license does not give you any ownership of the app itself. You may not copy, modify, decompile, reverse-engineer, redistribute, or create derivative works from the app, except to the extent applicable law expressly permits this despite this restriction.

4. Your content

You own everything you create in Trace — your photos, notes, titles, and memory records. We never see it, host it, or claim any rights to it, because it never leaves your device unless you choose to export or share it.

5. Acceptable use

You agree not to use Trace to store, generate, or share content that is illegal, infringes someone else's rights, or that you don't have the right to possess. You also agree not to attempt to disrupt, reverse-engineer, or gain unauthorized access to the app or any service it connects to (see Privacy Policy §3 for the specific third-party services the app uses).

7. Intellectual property

The Trace name, logo, and the app's design, code, and globe-visual system are owned by us (or our licensors) and are not covered by the content license in Section 4. Third-party components used in the app (map data, satellite imagery, open-source libraries) belong to their respective owners and are used under their own licenses.

8. No warranty

Trace is provided "as is" and "as available," without warranties of any kind, express or implied, including — to the extent permitted by law — implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or iOS version indefinitely.

9. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, memories, photos, or content, arising out of or related to your use of the app — even if we've been advised of the possibility of such damages. Where liability cannot be excluded by law, our total liability to you is limited to the amount you paid us (if any) in the 12 months before the claim arose.

Nothing in these Terms limits any liability that cannot legally be limited or excluded, such as liability for our own fraud or, where applicable, gross negligence.

10. Termination

You may stop using Trace at any time by deleting the app, which also deletes all of its local data from your device (see Privacy Policy §7). We may suspend or terminate your access to future updates or purchasable content if you materially violate these Terms, though because the app runs locally and requires no account, this has limited practical effect on data you already have on your device.

Because Trace is distributed through Apple's App Store, the following terms apply between you and us (not Apple), as required by Apple:

12. Changes to these terms

If we make significant changes to these Terms, we will update the effective date at the top of this page. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the app shall be brought exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction there. This does not deprive you of any consumer-protection rights you may have under the mandatory laws of your own country or state of residence, where such laws apply and cannot be waived by agreement.
